Wappinger Man Charged With Felony

On Wednesday August 20, 2014 at approximately 12:57am, members of the Dutchess County Sheriff’s Office responded for a suspicious vehicle on Maloney Rd in the Town of Wappinger. Deputy Sheriff’s located a 2006 Nissan operated by Shawn Michael Kelly (25 yoa) of Wappinger stopped on the road in the wrong lane of traffic. Subsequent investigation revealed that Kelly was wanted on a Dutchess County Probation Warrant and was also impaired by drugs as well as being in possession of marihuana.

He was arrested and charged with DWAI Drugs a misdemeanor, Unlawful Possession of Marihuana a violation, Aggravated Unlicensed Operation of a Motor Vehicle 1st a felony, other traffic infractions and on the warrant. The AUO charge was a felony since his license was revoked for a prior DWI related conviction and he was impaired by drugs while operating the vehicle. That revocation was on 10/21/09 for a DWAI conviction; however he also had 2 other active revocations and 2 suspensions on his license.

Kelly was held and later arraigned in the Village of Wappingers Falls Court where he was remanded to the Dutchess County Jail on bail for both the criminal charges as well as the probation warrant. He is scheduled to appear in the Town of Wappinger Court on August 22, 2014 at 10:00am.

All subjects arrested and charged are alleged to have committed the crime and are presumed innocent until proven guilty and are to appear in a local court at a later date.
