Poughkeepsie Man Arrested for Felony DWI & Criminal Impersonation

At approximately 1:14am on Thursday October 2, 2014, members of the Dutchess County Sheriff’s Office stopped a 2001 Lincoln Navigator on Spackenkill Road in the Town of Poughkeepsie after it had been observed moving from its lane in an unsafe manner several times on State Route 9. The vehicle was operated by Humberto Cruz-Santos (32 yoa) of Poughkeepsie, who initially told the deputies that he was Javier Cruz. Subsequent investigation revealed that he was intoxicated and that he had given a false name.

Humberto Cruz-Santos was charged with DWI, BAC .08% or more & Aggravated Unlicensed Operation of a Motor Vehicle 1st all felonies as well as Criminal Impersonation a misdemeanor. The DWI charges were felonies since he had a prior DWI related conviction within the past ten years, which was on January 10, 2005 in the Town of Poughkeepsie.

The AUO charge was a felony since he was operating the vehicle while his license was revoked for a DWI related conviction and he was intoxicated at the same time. His license had been revoked on January 10, 2005 for the same DWI related conviction stated above. Additionally, there was an Immigration Detainer Hold for him.

He was later arraigned in the City of Poughkeepsie Court and remanded to the Dutchess County Jail on $10,000/$20,000 bail. He is scheduled to appear in the Town of Poughkeepsie Court on October 7, 2014 at 4:30pm.

All subjects arrested and charged are alleged to have committed the crime and are presumed innocent until proven guilty and are to appear in a local court at a later date.
