Domestic Violence Arrest

The Dutchess County Sheriff’s Office reports the arrest of Heath Garber, age 35 of Milan NY, following an investigation into a domestic dispute which took place in the Town of Milan during the early morning hours of 4/27/13.

Sheriff’s Deputies responded along with the State Police to a residence on Becker Hill Rd at approximately 12:10 am on 4/27/13 for a domestic dispute, possibly involving a firearm. Upon arrival it was discovered that Mr. Garber had left the residence on foot, it was unknown if he was armed. At that time a Sheriff’s Office K-9 Unit was deployed, and Mr. Garber was located by the K-9 close to the scene and taken into custody without further incident. Further investigation then revealed that Mr. Garber had allegedly menaced another person with a shotgun, before then using it to fire two (2) rounds through the ceiling of the kitchen. No one was injured and the shotgun was recovered at the scene.

Mr. Garber has been charged with criminal mischief 3rd degree (Class E felony), menacing 2nd degree, reckless endangerment 2nd degree (both misdemeanors). After being processed Mr. Garber was arraigned before the Town of Milan Court and remanded to the Dutchess County Jail in lieu of $2,500 cash bail or $5,000 bond. Neither the other party involved nor the exact address where this occurred will be released in order to respect the privacy of domestic violence victims. As in all other criminal cases, the charges described are merely accusations and the defendant is presumed innocent until proven guilty in a court of law.
