At approximately 6:55 pm on Thursday February 1, 2018 David M. Kilmer (51 yoa) of Fishkill, NY was stopped by members of the Dutchess County Sheriff’s Office on Millholland Drive in the Town of Fishkill. Kilmer, who was operating a 2013 Chevrolet Pick-Up, had just been refused entry into the Victim Impact Panel due to a high blood alcohol content.
The Victim Impact Panel is a court ordered program operated by Council on Addiction Prevention and Education of Dutchess County. The program is held at the Town of Fishkill Town Hall. Attendees are ordered to appear after being convicted of alcohol or drug driving offenses. The program contains several volunteers whose lives have been impacted by serious or fatal crashes related to impaired driving incidents.
Kilmer was refused entry due to intoxication and was advised he was nearly three times the legal limit. He claimed he did not operate a vehicle before his attendance and was advised not to operate a vehicle and call for a ride home. Kilmer was observed leaving the parking lot a few minutes later in his Chevrolet pick-up. He was stopped on Millholland Drive and was arrested for DWI.
Subsequent investigation revealed that Kilmer was intoxicated, operating with a suspended and revoked drivers license. He was arrested and charged with Aggravated DWI (misdemeanor) and Felony Aggravated Unlicensed Operation in the 1st Degree. Aggravated Unlicensed Operation of a Motor Vehicle 1st is a felony since his license was both suspended and revoked for an alcohol related offense and he was intoxicated while operating the vehicle. Kilmer was ordered to attend the Victim Impact Panel due to an alcohol related driving offense conviction on January 18,, 2018 in the Town of Fishkill.
Kilmer was arraigned in Town of East Fishkill Court where he was remanded to the Duchess County Jail in lieu of $2,000 cash bail or $4,000 bond. He is scheduled to appear in the Town of Fishkill Court on February 7th at 9:00am
