Public Functions and Mass Gatherings

New York State and Dutchess County Sanitary Codes require the promoter of a public function or mass gathering to adequately ensure the safety and well-being of its attendees. Provisions such as crowd and traffic control, medical services, lighting, signage, and security, among others, must all be considered when planning such an event.
 

A Public Function is

  • Any large event of 5,000 people or more
  • Requires a permit from the Dutchess County Department of Behavioral & Community Health (DBCH)
  • Regulated by Part 18 of the New York Sanitary Code and Article 18 of the Dutchess County Sanitary Code. 

A Mass Gathering also requires a permit and is any event that is 

  • Likely to attract 5,000 people or more and; 
  • Continues for 24 hours or more but does not include a temporary residence already under permit. 

 

Public Function Requirements

  • An application for a permit to promote or hold a public function must be filed with DBCH at least five days before the first day of advertising and at least 30 days before the first day of the event.
  • An emergency medical services operational plan must comply with all regulations and any supplemental plans, reports and specifications as the permit-issuing official requires because of concerns raised by specific circumstances pertaining to the event
  • A crowd control plan must be submitted to DBCH, which must also be filed with the New York State Emergency Management Office
  • Onsite Emergency Health Care facilities must be provided (Please see the regulations for specific requirements regarding supplies, equipment, personnel, and ambulances)
  • Public function medical incident log (.pdf) must be maintained for people who have been treated at the event
  • Prior approval from the local town/village or municipality must be obtained
  • Documentation must be submitted to DBCH indicating that local, municipal, and public safety officials, including police, fire and local emergency medical services personnel have been advised of the event
  • Additional equipment, supplies, personnel must be provided if attendance exceeds the estimated permitted amount
  • Any other matters deemed necessary by the permit issuing official to protect life and health or required by the Sanitary Codes. 

Public Function Regulations

Mass Gathering Requirements

  • An application for a permit to promote or hold a mass gathering must be filed with DBCH at least 15 days before the first day of advertising and at least 60 days before the first day of the event.
  • Sewer and water facilities are to be constructed and approved no later than 48 hours before the first day of the gathering
  • Children under 16 years of age must have adequate supervision
  • Adequate medical care must be readily available
  • A responsible party must be available on site to maintain the facilities for the duration of the event 
  • A site map must be made available to all attendees that show the location of all facilities
  • Signage must be present to help locate facilities
  • Lighting must be adequate
  • Adequate maintenance and internal security staff are required
  • Traffic control measures must be sufficient 
  • Flammable and volatile liquids may not be stored in or adjacent to the area of the gathering 
  • Adequate firefighting measures and equipment must be available
  • A comprehensive engineering report with the requirements listed in Subpart 7-4 of the New York State Sanitary Code must be submitted to DBCH.
  • Any other matters deemed necessary by the permit issuing official to protect life and health or required Sanitary Codes.
